Pilot ejected when small airplane dives near Chattanooga; search under way

The body of a student pilot who was ejected from a small aircraft above an area east of Chattanooga, Tenn., in a freak accident Friday evening was found on Saturday, authorities said.

The man?s body was located after 8 a.m. local time, Bob Gault, a spokesman for the Bradley County Sheriff?s department, told NBC News.

The accident occurred when the owner of the Zodiac 601XL plane was taking lessons from an instructor, NBC station WRCB of Chattanooga reported, citing police. A malfunction caused the plane to nose dive and the canopy flew open ? and neither man was wearing a seat belt, WRCB reported.

The accident occurred at about 2,500 feet,?the Chattanooga Times Free Press reported.?

The instructor was able to land the aircraft back at Collegedale Municipal Airport, operations manager Chris Hancock confirmed to NBC News. He directed further questions to a Collegedale police spokesman who could not immediately be reached.

?The people inside the plane were not wearing seat belts,? said Troy Spence, director of the county?s emergency management agency, according to WRCB. ?So when they lost control of the plane, in an attempt to regain control of the plane, the passenger was ejected.?

Authorities conducted a ground search in Bradley County, WRCB said. The Times Free Press said the owner-pilot had a cell phone with him and rescuers pinged it in an attempt to find him.

Neither of the men was identified publicly by authorities.

WRCB said the plane had been owned by a man killed in a December crash and then was sold to the current owner, described as an experienced pilot who wanted more training in the Zodiac.

The Zodiac 601XL is a single-engine kit aircraft offered for home builders. Its two seats are side by side under a large domed canopy.

High court could upend civil rights policies

WASHINGTON (AP) ? Has the nation lived down its history of racism and should the law become colorblind?

Addressing two pivotal legal issues, one on affirmative action and a second on voting rights, a divided Supreme Court is poised to answer those questions.

In one case, the issue is whether race preferences in university admissions undermine equal opportunity more than they promote the benefits of racial diversity. Just this past week, justices signaled their interest in scrutinizing affirmative action very intensely, expanding their review as well to a Michigan law passed by voters that bars "preferential treatment" to students based on race. Separately in a second case, the court must decide whether race relations ? in the South, particularly ? have improved to the point that federal laws protecting minority voting rights are no longer warranted.

The questions are apt as the United States closes in on a demographic tipping point, when nonwhites will become a majority of the nation's population for the first time. That dramatic shift is expected to be reached within the next generation, and how the Supreme Court rules could go a long way in determining what civil rights and equality mean in an America long divided by race.

The court's five conservative justices seem ready to declare a new post-racial moment, pointing to increased levels of voter registration and turnout among blacks to show that the South has changed. Lower federal courts just in the past year had seen things differently, blunting voter ID laws and other election restrictions passed by GOP-controlled legislatures in South Carolina, Texas and Florida, which they saw as discriminatory.

"Whenever a society adopts racial entitlements, it is very difficult to get out of them through the normal political processes," Justice Antonin Scalia said in oral arguments earlier this year, suggesting that it was the high court's responsibility to overturn voting protections overwhelmingly passed by Congress in 2006.

Justice Ruth Bader Ginsburg, part of the court's more liberal wing, countered that while conventional discriminatory tactics may have faded, new ones have emerged. "Congress said up front: We know that the (voter) registration is fine. That is no longer the problem. But the discrimination continues in other forms," she said.

The legal meanings of "equality," ''racism" and "discrimination" have been in flux since at least 1883, when justices struck down a federal anti-discrimination law, calling it an unfair racial advantage for former black slaves. Today, justices face the question of whether the nation has reached equality by a 1960s definition or some new standard.

By some demographic measures, America has reached a new era. But the latest census data and polling from The Associated Press also show race and class disparities that persist.

President Barack Obama, the nation's first black chief executive, was re-elected in November despite a historically low percentage of white supporters. He was aided by a growing bloc of blacks, Hispanics, Asian-Americans and gays, and a disproportionate share of women, who together supported him by at least a 2-to-1 margin.

Another sign of shifting times: Among newborns, minorities outnumbered whites for the first time last year, the Census Bureau reported. "The end of the world as straight white males know it," one newspaper headline said on the morning after the November election.

Still, issues linger by race, age and class:

?Jobs and income. Black poverty has fallen by half since 1959, to 27.6 percent, but is still nearly three times the poverty rate of whites. Black and Hispanic men are twice as likely as whites to work in the low-paying service sector. Since the 1970s, the unemployment rate for blacks has remained double that of whites.

?Wealth. The wealth gap between whites and minorities is at its widest since 1984. Predominantly younger minorities were hit hard when home prices fell, while older whites were more likely to invest in 401(k) retirement plans and stocks, which have rebounded since the recession. The median net worth of white households was $113,149 in 2009, compared with $6,325 for Hispanics and $5,677 for blacks.

?Class and education. By some measures, the gap between rich and poor has stretched to its widest since 1967. Globalization and automation have eliminated many mid-skill jobs, leaving a polarized pool of low-wage work and high-skill jobs requiring advanced degrees. About 40 percent of whites age 25-29 graduate from college, compared with 15 percent for Latinos and 23 percent for blacks.

?Racial bias. Prejudice against blacks worsened slightly in the four years since Obama was first elected in 2008, according to an AP poll. In all, 51 percent of Americans expressed explicit anti-black attitudes, compared with 48 percent in 2008. Questions designed to ferret out subconscious bias raised the proportion with anti-black sentiments to 56 percent, and the share of people expressing pro-black attitudes fell.

Roderick Harrison, a demographer who is black, says he felt pride in Obama's re-election, which to him reaffirmed a historic achievement not only for black Americans but also a broader coalition of racially diverse groups. Still, he worries that demographic change and Obama's success may lead to a tipping point in the opposite direction, where people in the United States are led to assume racial equality has fully arrived.

The strength of minority support behind Obama was aided by the 1965 Voting Rights Act and other protections, he said.

The term "minority" often refers to an unequal or disadvantaged status and isn't always about numbers or counts, said Harrison, a former chief of racial statistics at the Census Bureau. The District of Columbia, Hawaii, California, New Mexico and Texas already have populations of racial and ethnic minorities that collectively add up to more than 50 percent. Across the U.S., more than 11 percent of counties have tipped to "majority-minority" status.

"Minority status is a matter of exclusion from full participation in society, remaining long after a nation becomes 'majority minority,'" Harrison said.

To Bradley Poole, 21, a senior at the University of Texas at Austin, racial progress is measured by the little things. An advertising major, Poole became a member and then president of the school's Black Student Alliance, seeking camaraderie after noticing he often was the only African-American in his classes.

"I definitely feel the difference," he said.

The university automatically grants admission to the top 10 percent of students in each of the state's high schools. That helps bring in students of different backgrounds because Texas high schools are highly racially segregated, reflecting decades of segregated neighborhoods.

In a state where blacks now make up 11.5 percent of the population and Hispanics 38 percent, the university's enrollment of 50,000 students never rose above 3 percent to 4.5 percent black and 13 percent to 17 percent Hispanic. So in 2004 it decided to allow students who miss the 10 percent cutoff to be considered for admission based on a range of socioeconomic factors, including race.

The share of black students has since increased slightly to 6 percent, while Hispanic enrollment rose to 26 percent.

The university's affirmative action plan is being challenged in the Supreme Court by Abigail Fisher, a white student who missed the cutoff and was rejected. Fisher says she was denied fair consideration because of her race.

A 2003 Supreme Court opinion said universities may consider race only as one of several factors to promote diversity. The court said diversity benefits everyone because in a global economy it fosters leaders who can relate to people of different backgrounds.

In the last week, justices also agreed to take up a second affirmative action case this year, deciding whether states may pass laws that restrict the use of race preferences in college admissions. That case involves an appeal to a lower court ruling that found a 2006 voter-approved ban in Michigan unconstitutional, reasoning that such bans put minorities at a disadvantage.

The justices' decision to hear the Michigan case next fall ? with their decision in the Texas case still to be announced this spring ? suggests that the court will not decide in the Texas case to eliminate affirmative action programs in higher education.

In the seven or so states that enacted bans on affirmative action at their public universities, freshman enrollments of blacks and Hispanics almost always fell afterward ? as much as 50 percent at UCLA and the University of California, Berkeley ? although in some cases they later rebounded. Those states now include Arizona, California, Florida, Nebraska, New Hampshire, Oklahoma and Washington. A Supreme Court ruling that further restricts affirmative action could shake up college admissions policies nationwide, perhaps shifting focus to low-income students or low-performing schools.

Before opting to enroll at Texas, Poole says he considered attending a mostly white university in Iowa and a historically black college in Louisiana. The college course he now values the most: an advertising seminar that he attended along with a Hispanic, a female student-athlete and an Asian-American. No one in that class was a "minority," he said, and there was a range of perspectives.

Outside class, Poole says his organization has experienced racial incidents. One white student ran up in "blackface" to where members were gathered on campus, daring them to respond. A legal brief filed by the National Association for the Advancement of Colored People on behalf of Poole's group lists other racial incidents in recent years, some of which led to suspensions or public apologies.

"Racial diversity is a conversation we need to have," he said.

Not since the tumultuous 1960s have U.S. ideals of equality been more closely contested. Legal analysts say a Supreme Court holding of a colorblind Constitution, either as a matter of law or practical effect, could begin to emerge in two rulings on voting rights and affirmative action due out by late June. A third ruling in the Michigan affirmative action case will come next term.

The five conservative justices who make up a majority could overturn the 2003 opinion or take a less dramatic step. The court may opt for tighter restrictions that make it difficult for colleges to consider race or rule narrowly that in a situation like Texas, its unique top 10 percent plan is enough on its own to achieve diversity.

In the court's other racial case, a conservative majority may declare the 1965 Voting Rights Act constitutionally flawed for its focus on racism in the South but leave it up to lawmakers to sort it out.

The court could also find a less sweeping, more technical way of deciding the voting rights case, much as they did four years ago. Back then, Chief Justice John Roberts suggested Congress should update the law to reflect improved conditions in the South. Congress hasn't done so.

Prominent legal bloggers are already warning of sharp public reaction, especially if justices strike down federal voting protections.

"If the court rules in a conservative direction, this will be a pivotal year with regard to race in the Constitution and a year that could have a devastating effect on racial diversity," adds Erwin Chemerinsky, dean of the University of California, Irvine law school.

Has the country put its racist past behind it? That question is at the core of the challenge to the Voting Rights Act. The arguments before the court raised questions about whether new, more subtle forms of voting discrimination have taken the place of Jim Crow laws.

In 1870, the Constitution guaranteed blacks the right to vote. But for many decades afterward, whites in the post-slavery South used poll taxes and literacy tests to block African-Americans from voting.

That changed in 1965 with enactment of the Voting Rights Act, which let minorities file lawsuits against voter discrimination. Section 5 of that law went even further, requiring nine states, mostly in the South, and scores of counties and townships in seven other states, all with histories of disenfranchisement, to get federal approval before making any election change. Changes can include everything from a different poll location to a new political redistricting map.

The voting act was renewed by Congress in 2006 for another 25 years. The Justice Department and the federal courts last year used Section 5 to block voter restrictions in South Carolina, Texas and parts of Florida. That saved hundreds of thousands of votes that would otherwise have been lost in November, according to the Brennan Center for Justice. Many were cast by blacks and Hispanics who turned out for Obama.

Lawyers for Shelby County, Alabama, which is challenging Section 5, say the tables have turned in a nation that is now much more racially diverse, with minority voters possibly holding an unfair advantage.

"You have a different constituency from the constituency you had in 1964," attorney Bert Rein told the justices. "Senators who see that a very large group in the population has politically wedded themselves to Section 5 are not going to vote against it."

Richard Hasen, a law professor at the University of California, Irvine, and author of Election Law Blog, says the "smart money" now is on the Supreme Court striking down Section 5, leading to consequences for minority voters such as "more brazen partisan gerrymanders, cutbacks in early voting and imposition of tougher voting and registration rules in the formerly covered jurisdictions."

But if the court strikes down "a crown jewel of the civil rights movement," he said, that could spark a public backlash that sends Congress back to the drawing board, with any resulting new law applying equally to all states.

Mathematician publishes 2013 Major League Baseball projections

Mar. 28, 2013 ? It looks like 2013 will be a thrilling season for baseball fans as four of the six divisions can be expected to deliver tight races, says baseball guru NJIT Associate Professor and Associate Dean Bruce Bukiet. Over the years, Bukiet has applied mathematical analysis to compute the number of regular season games each Major League Baseball team should win. Though his expertise is in mathematical modeling, his projections have compared well with those of so-called experts.

The numbers indicate that only one game might separate the first and second place teams in both the National League's (NL) East and West divisions, with the Atlanta Braves (94 wins) edging out the Washington Nationals (93 wins) in the East and the Los Angeles Dodgers (88 wins) coming in just ahead of the San Francisco Giants (87 wins) in the West. Even in the NL Central, the St. Louis Cardinals (90 wins) don't have much breathing room, winning that division by a projected 3 games over the Cincinnati Reds (87 wins). The Braves, Nationals, Cards, Reds and Dodgers should make the playoffs, while the Giants miss by a single game.

It is hard to believe that in the American League (AL), the contests could be even closer. While the Detroit Tigers should have the best record in baseball (102 wins) and run away with the Central division, with the next best team (the Chicago White Sox) more than 20 wins behind, the other two divisions could end up in ties. In the AL West, Bukiet has the Anaheim Angels and the Oakland Athletics tied with 92 wins each, while in the AL East, he says there could be a 3-way tie!!! The guru predicts that the Toronto Blue Jays, the Tampa Bay Rays and the New York Yankees all will win 87 games. Such results would mean that the Tigers, Angels, and Athletics would make the playoffs, while the other two teams to make the playoffs would be from among the Blue Jays, Rays, Yankees or Texas Rangers, all whom the model show come in at 87 wins.

Bukiet makes these projections to demonstrate and promote the power of math. He wants to show young people that math can be fun, that it can be applied to improve one's understanding of many aspects of life and that if you love mathematics, it can be a great college major and lead to a satisfying career.

Bukiet bases his predictions on a mathematical model he developed in 2000. He has made revisions over the years. His results have led to back-to-back wins for himself in 2010-2011 as predictions champ at baseballphd.net.

Bukiet should have plenty of time this summer to spend doing math since once again his favorite team, the New York Mets, should win the same number of games (74) as they did last year. Once again they should come in fourth in their division, while the Miami Marlins have the worst record in the NL with 59 wins. The worst team overall should be the Houston Astros in their debut in the AL with only 56 successful outcomes and 106 losses. Yes, and once again, for the 21th year in a row, the Pittsburgh Pirates should finish with a losing record.

Former Pennsylvania state trooper kills wife then himself

(Reuters) - A former Pennsylvania state trooper killed his estranged wife on Thursday before taking his own life in a Decatur Township grocery store, according to state police and local media.

Investigators said Mark Miscavish, 51, went to the County Market, where his wife Traci worked, found her in an upstairs office and shot her with a shotgun before shooting himself at about 10 a.m.

Traci Miscavish, 49, filed for divorce on Friday, according to Centredaily.com. Her husband was a state policeman for 15 years, the Web site said.

Mark Miscavish was arrested on January 23 after he allegedly assaulted his wife and threatened to kill her, according to Centredaily.com.

Traci Miscavish was granted a protection-from-abuse order while her husband faced charges stemming from the incident, the site said.

Decatur Township is about 130 miles northeast of Pittsburgh.

Lunar cycle determines hunting behavior of nocturnal gulls

Mar. 27, 2013 ? Zooplankton, small fish and squid spend hardly any time at the surface when there's a full moon. To protect themselves from their natural enemies, they hide deeper down in the water on bright nights, coming up to the surface under cover of darkness when there's a new moon instead. Scientists at the Max Planck Institute for Ornithology in Radolfzell discovered that this also influences the behaviour of swallow-tailed gulls (Creagrus furcatus), a unique nocturnal species of gull from the Galapagos Islands.

They fitted the birds with loggers and wet/dry sensors which enabled them to see how much time the animals spent at sea at night. Their findings show that the birds' activity was greatest at new moon, in other words the time when the most prey was gathered at the surface of the water. The cycle of the moon therefore also influences the behaviour of seabirds.

The lunar cycle controls the behaviour of various animal species: owls, swallows and bats, for example, align their activity with the phase of the moon to maximise their hunting success. However, marine life is also affected by the moon. Many species of fish hide from their enemies in the depths of the sea during the daytime and only come up to the water's surface in the dark. Known as vertical migration, this phenomenon is additionally influenced by the lunar cycle. The fish thereby avoid swimming on the water's surface at full moon where they would be easy prey. Vertical migration is thus restricted on brighter nights and the animals remain at greater depths. At new moon, on the other hand, the organisms become active and migrate to the surface.

Yet also in the dark of night hunters lie in wait for them -- for instance the swallow-tailed gull Creagrus furcatus from the Galapagos Islands. With eyes that are well adapted to the dark, the gull can see fish below the water's surface even in low light conditions and so does not need the moon as a source of light. Scientists from the Max Planck Institute for Ornithology therefore wanted to find out what effect the lunar cycle had on the hunting behaviour of the gulls.

To this effect, they attached loggers with sensors to 37 birds, which enabled the scientists to measure where, when and how long the animals were in the water. "The gulls fly off to hunt on the open sea and plunge down to the water's surface to snatch squid or small fish," explains Martin Wikelski from the Max Planck Institute in Radolfzell. "From the contact time of the sensors with the water, we were able to conclude in which nights of the month the gulls were particularly active." The behaviour of each bird was recorded for 120 days on average in order to take in several moon phases.

The birds followed the lunar cycles strictly: at new moon the gulls were in the water particularly often. When the nights were very bright, the birds tended to stay on dry land instead. "For the swallow-tailed gulls it makes sense to be guided by the lunar cycle in their hunting, because, with a diving depth of no more than one metre, the prey is quickly beyond their reach on nights with a full moon," says Wikelski.

To facilitate their night-time hunting, swallow-tailed gulls have evolved light-sensitive eyes that are particularly well adapted to the dark nights at sea. They have also lost their melatonin rhythm -- an important clock that regulates sleep -- enabling the swallow-tailed gulls to occupy a new and unique ecological niche.

Ky. lawmakers override religious freedom veto

FRANKFORT, Ky. (AP) -- Kentucky lawmakers have voted to override the governor's veto of a bill intended to better protect legal claims of religious freedom.

The law will give stronger legal standing to people in court who claim the government burdened their ability to practice their religion. The legislation protects "sincerely held religious beliefs" from infringement unless there is "a compelling governmental interest." The courts will still consider and rule on each matter.

Democratic Gov. Steve Beshear vetoed the bill Friday over concerns that someone's claim of religious freedom could undermine civil rights protections for gays and lesbians and lead to costly lawsuits for taxpayers.

But bill sponsors said it would only provide a higher level of legal protection that already exists on the federal level and in at least 16 states. The debate pitted civil liberties groups like the ACLU against religious organizations such as the Catholic Conference of Kentucky. Lawmakers voted Tuesday to override.

Google adds street views inside Japan nuclear zone

(AP) ? Concrete rubble litters streets lined with shuttered shops and dark windows. A collapsed roof juts from the ground. A ship sits stranded on a stretch of dirt flattened when the tsunami roared across the coastline. There isn't a person in sight.

Google Street View is giving the world a rare glimpse into one of Japan's eerie ghost towns, created when the March 2011 earthquake and tsunami sparked a nuclear disaster that has left the area uninhabitable.

The technology pieces together digital images captured by Google's fleet of camera-equipped vehicles and allows viewers to take virtual tours of locations around the world, including faraway spots like the South Pole and fantastic landscapes like the Grand Canyon.

Now it is taking people inside Japan's nuclear no-go zone, to the city of Namie, whose 21,000 residents have been unable to return to live since they fled the radiation spewing from the Fukushima Dai-ichi nuclear power plant two years ago.

Koto Naganuma, 32, who lost her home in the tsunami, said some people find it too painful to see the places that were so familiar yet are now so out of reach.

She has only gone back once, a year ago, and for a few minutes.

"I'm looking forward to it. I'm excited I can take a look at those places that are so dear to me," said Naganuma. "It would be hard, too. No one is going to be there."

Namie Mayor Tamotsu Baba said memories came flooding back as he looked at the images shot by Google earlier this month.

He spotted an area where an autumn festival used to be held and another of an elementary school that was once packed with schoolchildren.

"Those of us in the older generation feel that we received this town from our forbearers, and we feel great pain that we cannot pass it down to our children," he said in a post on his blog.

"We want this Street View imagery to become a permanent record of what happened to Namie-machi in the earthquake, tsunami and nuclear disaster."

Street View was started in 2007, and now provides images from more than 3,000 cities across 48 countries, as well as parts of the Arctic and Antarctica.

Scientists image deep magma beneath Pacific seafloor volcano

Mar. 27, 2013 ? Since the plate tectonics revolution of the 1960s, scientists have known that new seafloor is created throughout the major ocean basins at linear chains of volcanoes known as mid-ocean ridges. But where exactly does the erupted magma come from?

Researchers at Scripps Institution of Oceanography at UC San Diego now have a better idea after capturing a unique image of a site deep in the Earth where magma is generated.

Using electromagnetic technology developed and advanced at Scripps, the researchers mapped a large area beneath the seafloor off Central America at the northern East Pacific Rise, a seafloor volcano located on a section of the global mid-ocean ridges that together form the largest and most active chain of volcanoes in the solar system. By comparison, the researchers say the cross-section area of the melting region they mapped would rival the size of San Diego County.

Details of the image and the methods used to capture it are published in the March 28 issue of the journal Nature.

"Our data show that mantle upwelling beneath the mid-ocean ridge creates a deeper and broader melting region than previously thought," said Kerry Key, lead author of the study and an associate research geophysicist at Scripps. "This was the largest project of its kind, enabling us to image the mantle with a level of detail not possible with previous studies."

The northern East Pacific Rise is an area where two of the planet's tectonic plates are spreading apart from each another. Mantle rising between the plates melts to generate the magma that forms fresh seafloor when it erupts or freezes in the crust.

Data for the study was obtained during a 2004 field study conducted aboard the research vessel Roger Revelle, a ship operated by Scripps and owned by the U.S. Navy.

The marine electromagnetic technology behind the study was originally developed in the 1960s by Charles "Chip" Cox, an emeritus professor of oceanography at Scripps, and his student Jean Filloux. In recent years the technology was further advanced by Steven Constable and Key. Since 1995 Scripps researchers have been working with the energy industry to apply this technology to map offshore geology as an aid to exploring for oil and gas reservoirs.

"We have been working on developing our instruments and interpretation software for decades, and it is really exciting to see it all come together to provide insights into the fundamental processes of plate tectonics," said Constable, a coauthor of the paper and a professor in the Cecil H. and Ida M. Green Institute of Geophysics and Planetary Physics at Scripps. "It was really a surprise to discover that melting started so deep in the mantle -- much deeper than was expected."

Key believes the insights that electromagnetics provides will continue to grow as the technology matures and data analysis techniques improve (last week Key and his colleagues announced the use of electromagnetics in discovering a magma lubricant for the planet's tectonic plates).

"Electromagnetics is really coming of age as a tool for imaging the earth," said Key. "Much of what we know about the crust and mantle is a result of using seismic techniques. Now electromagnetic technology is offering promise for further discoveries."

Key also has future plans to apply electromagnetic technology to map subglacial lakes and groundwater in the polar regions.

In addition to Key and Constable, coauthors of the paper include Lijun Liu of the University of Illinois and Anne Pommier of Arizona State University.

The study was supported by the National Science Foundation and the Seafloor Electromagnetic Methods Consortium at Scripps.

Seasoned skiers want to know there?ll be snow to greet them once they reach the slopes, but for the beginner too, greater heights often mean the presence of powder on the lower slopes, and can ensure hassle-free skiing to and from your lodgings. At this stage in the season, it?s smart to head for the ski villages, which still promise a few months of cold weather. But where in the world can these record-breaking resorts be found?

France boasts most of the soaring climes in Europe and with its champion Val Thorens being the highest of them all, snow-sure is a by-word that gets used a lot in the French Alps. A good range of easy and challenging runs bordering the vast Three Valleys area keep this purpose-built resort thronging. But Val Thorens isn?t the only place in these parts where you can ski until May; the villages of Tignes offer heights of 2,300 meters (Val Claret), and Couchevel?s lifts reach up to 2,700 though the village itself is much lower.Screen shot 2013-03-25 at 7.37.46 PM

Across the Atlantic, the soaring heights of Whistler Blackcomb in British Columbia is home to one of the most extreme vertical drops in North America and the ski area itself is a hotbed of statistics, with a total of 38 lifts spanning one of the largest and most highly-rated resorts in the world. There?s a worthy rival over the border into the US, however, with Breckenridge in Colorado recently installing an impressive chair-lift that reaches heights of almost 4,000 meters.

The ski resort of Chacaltaya in Boliva held the title of the tallest in the world until just a few years ago, when melting snows forced it to close down. Thankfully, oxygen masks are provided. Elsewhere on the continent, Iran presents a surprising alternative to many lower European resorts with the high altitudes and reliable snows at places like Dizin, near Tehran.

Of course, the other advantages of opting for high-altitude skiing are that you can be a bit more flexible in your timing and land some bargain holidays if you plan well. Try grabbing accommodation at the lower villages near the mountain-top runs; less convenient but more value for your money. Post-Easter ski trips can be a more peaceful experience in any case and with a few snow-sure days or weeks to look forward to, you can practice those turns at your leisure.

Questions remain after Obama?s Israel trip

President Obama almost made it through his trip to Israel without demonstrating the incoherence at the heart of his approach to the region. Almost.

If he now understands and can recite how many times Israel has offered the Palestinians their own state, why was he lecturing Israeli students on the unjustness of the Palestinians lack of statehood?

If he extolled Israeli democracy, why wasn?t he telling?Mahmoud Abbas to have free and fair elections?

If he understands that there are to be ?two states for two peoples,? why doesn?t he adopt as U.S. policy ? as he did with ?1967 borders? plus land swaps ? the truism that the right of return?for Palestinians must be only?to the Palestinian state?

If he respects the Israelis? elected government and its right to make decisions on its own, why go to a university to implore college kids to lobby their government to make peace? And what else could Israel offer that hasn?t been tried already?

The biggest impediment to peace, of course, is that the Palestinian Authority has made a pact with Hamas. Maybe Obama should have mentioned that and the impossibility of a Palestinian state so long as that embrace continues.

The problem with merely changing rhetoric is that exposes the gap between speeches and mindset and between rhetoric and actions.

Nevertheless, friends of Israel will be glad to hear that Obama will leave the fruitless peace processing to Secretary of State John Kerry and not use his own good offices to strong-arm Israel. And?Obama has dropped the ?illegitimate? modifier to ?settlements.?

The most curious part of the trip came at the very end. I?have a great deal of sympathy?with this sentiment expressed by the New York Sun:

Mr. Obama ended his visit by hornswoggling Prime Minister Netanyahu into apologizing to the Turkish premier, Recep Erdogan, for the deaths on the?Motor Vessel Mavi Marmarra.?We don?t fault Mr. Netanyahu. . . .?But sending the?Mavi Marmarra?to run Israel?s blockade was one of the most provocative acts any major country has ever countenanced against Israel. The blood of the nine dead is entirely on Turkish hands. It was the Turk who owed the apology. By maneuvering things the other way around Mr. Obama offered an incentive for more trouble that will mar the good feelings he seems so sincerely to want to engender.

Ironically, what?a U.N. investigation?defended (astonishingly for the United Nations)?? Israel?s right of self-defense and right to maintain a blockade? Obama pressured Israel to apologize for to the enablers of the raid.

One can argue that the terms if the apology are muted. It went to pains to reiterate that?Israel?s own report found there?were missteps (?In light of Israel?s investigation into the incident, which pointed to a number of operational mistakes, the prime minister expressed Israel?s apology to the Turkish people for any mistakes that might have led to the loss of life or injury?).

One can hope that Israeli Prime Minister Benjamin Netanyahu got something more than restoration of diplomatic relations (A green light from Obama on Iran? A promise of bunker-buster bombs?) to make it worth his while. But to the outside world this will look like the United States leaning on Israel to apologize for defending itself. That, unfortunately, sends the wrong signal to the PA, Hamas, Turkey?and just about everyone in the region. And unless Israel got something very dear in return, it suggests that Obama still views Israel as the party responsible for conflict and violence.

Italy court to decide whether Amanda Knox should be tried again for murder

In the six years since Seattle student Amanda Knox was tried for murder in Italy, she was convicted, spent four years in jail, and was finally acquitted. In a new twist, prosecutors are asking the court to try the case again. NBC's Michelle Kosinski reports.

ROME -- Italy's highest court was set to decide whether to overturn the acquittal of American student Amanda Knox in the murder of her roommate.

Knox and her then-boyfriend Raffaele Sollecito were both convicted and then acquitted of Meredith Kercher's 2007 murder in Perugia, Italy, where they were students.

Knox spent four years in prison after being found guilty.

Small-time drug dealer Rudy Hermann Guede, an acquaintance of Knox's, was also convicted and was jailed for 16 years.

Prosecutors argued that Knox and Sollecito killed Kercher after a drug-fueled sexual assault.

The long legal saga of Amanda Knox, an American student accused of the violent death of her roommate, British student Meredith Kercher, has made headlines around the world since it began in Perugia, Italy, in late 2007.

If judges reject the prosecutors' argument that the acquittal should be thrown out and a new trial ordered, Knox's acquittal will be final.

"The only way the evidence could be characterized was absent, non-existent, inconclusive and unreliable," said Theodore Simon, Knox's defense attorney.

The scant DNA evidence initially linking Knox and Sollecito the murder was later found to have likely been contaminated. Defense attorneys argued that Guede was the sole killer and that the acquittal was justified.

Since her release from prison in 2011, Knox has resumed her studies in Seattle.

Knox and Sollecito did not appear in court Monday.

Italy's supreme court, which originally was expected to make a decision on Monday, has postponed their ruling until Tuesday.

Then again, we can only offer you so many suggestions before we open this question up to the folks in the peanut gallery -- so what do you peeps down there think?

American Eagle Outfitters shows its cheeky side in a video ad for a new pair of skinny jeans so tight, they?re practically sprayed on.

That?s because they are.

It takes a brave person to wear the AEO Skinny Skinny, hawked in a 30-second faux ad going viral. The video features young people expressing ways to emphasize their creativity and individuality ? and their preference for jeans that feel like almost nothing.

For the record, Skinny Skinny spray-on jeans don?t exist, said Bob Holobinko, vice president of brand marketing for American Eagle.

"We are not selling it, just to be clear,? he clarified Friday on TODAY, as two models showed off the "jeans." The brave pair were painted for the appearance in conjunction with CollegeHumor.com.?

?We just wanted to have fun, and have fun with our fans,? he said. ?And it was a good opportunity to kind of push it from a brand standpoint and the response has been incredible.?

The YouTube video has generated more than 348,000 views so far.

In the ad, one young man says, ?I like skinny jeans. Sometimes they?re not skinny enough.? He is then shown skateboarding wearing a jacket and nothing below but some dark blue spray paint.

A woman declares, ?I love really skinny jeans,? before the camera shows a tight shot of her "Avatar"-blue derriere.

Peter Shankman, an independent marketing consultant, called the campaign ?brilliant.? Although people watching the ad knows the product is fake, it still draws them to the retailer?s website.

?Let?s be honest, when was the last time you heard about a good American Eagle ad?? he said. ?It was a while ago. So this is phenomenal. A great way to bust out from the mainstream. People are talking about it.?

Holobinko said the video is the first installment of a campaign they consider ?a journey.? A second release will be issued next week and people who enter their email on the ?Skinny Skinny? site will get additional information.

?So for all of our customers that have come along with us, there?s going to be a really great reveal at the very end,? he said.

Although some may consider the commercial daring, Holobinko said they were very careful putting the final product together.

?We knew we were putting ourselves out there, I think that was the goal,? he said. ?But even through the edit and through the filtering process we had to be cautious of what we were showing. But we think we landed in a good spot.?
